Court to Reexamine Decision That Permitted Former President to Deploy Troops to Oregon City
The ninth circuit court has upheld a ban on deploying state troops in the Oregon city, after a recent court ruling.
Judicial Panel Agrees to Rehear Case
The ninth circuit court of appeals ruled on this week that it would reexamine the legal dispute concerning the executive power with an expanded group of 11 judges. The court also overturned a previous decision from a smaller judicial group that had supported the federal government.
Legal Saga Over Troop Deployment
This order represents the most recent turn in a long-running legal battle over whether the former president has the authority and justification to send state military units in the city. Approximately two hundred troops have been in uncertainty since the end of September when the mobilization attempt was initiated in due to ongoing demonstrations.
Conflicting Arguments
The administration has argued that federal officials at the ICE facility in south Portland were facing threats, while local authorities maintain that local officers have command of the situation.
Contrary to characterizations of Portland as “war ravaged”, residents have been sharing videos of lush hiking trails and a thriving food scene, and planning events such as an protest bicycle event against the “militarization of our city”.
Recent Legal Actions
The Tuesday ruling came after a US district judge in Portland enacted two temporary restraining orders this month – one blocking the federalization of the state troops, and another stopping the use of any national guard troops in Oregon, after attempts to evade the initial injunction by calling up troops from California.
On Monday, the ninth circuit panel had temporarily suspended the initial decision – allowing command of state troops – but the second ruling remained in place, blocking the physical sending of the troops.
Full Panel Consideration
The latest ruling means the matter will be heard by the full court – with all decisions under consideration simultaneously – by a group of 11 judges.
“This ruling shows that the truth matters and that the judicial system are striving to ensure government responsibility. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a training ground for expansive government power,” said the legal representative in a official comment.
“The judicial body is sending a clear message: the executive leader cannot send the military into American urban areas unnecessarily. We will continue protecting Oregon’s laws, principles, and sovereignty as this legal proceeding moves forward and our fight continues in the judicial system.”
